Jeremy McGilvrey LLC (“Company,” “we,” “us,” “our”) respects your privacy. By using the Services, you consent to this Privacy Policy.
If you are a client using our Services for your business, you are responsible for your own privacy notices to your customers. For some data we act as your processor and for other data we act as a controller, as described below.

1. Scope and Roles
- Controller. We act as a controller for personal information we collect about visitors, leads, and clients of Jeremy McGilvrey LLC.
- Processor. When we host, build, or operate websites or funnels for a client and process that client’s customer data under a services agreement, we act as a processor to that client. In those cases we process personal information only on the client’s instructions and our client’s privacy policy applies to their end users.
2. Notice at Collection – Categories, Sources, Purposes, Disclosures, Retention
We collect the following categories of personal information from the sources and for the purposes listed below. We retain personal information for the periods stated or, if no fixed period is stated, for as long as necessary for the purpose collected and to comply with legal obligations.
Identifiers – name, alias, email, phone, mailing address, IP address, device IDs
- Sources. Directly from you, from cookies and analytics tools, from business partners
- Purposes. Account setup, service delivery, billing, authentication, security, customer support, marketing communications, analytics, fraud prevention
- Disclosures. Service providers and processors such as hosting, analytics, billing, email, and security vendors
- Retention. Account lifetime plus up to 3 years or longer where required by law
Commercial information – records of products or services purchased, considered, or returned

- Purposes. Order processing, accounting, customer support, analytics
- Disclosures. Payment processors and accounting tools; we do not store full payment card numbers
- Retention. Transaction date plus 7 years for tax and accounting
Internet or network activity – browsing history on our site, referring URLs, pages viewed, session duration, interactions, crash logs

- Purposes. Site operations, security, debugging, analytics, improving Services, marketing measurement

- CPRA. We do not use or disclose sensitive personal information for purposes that require a right to limit under California law
We do not knowingly collect information from children under 13. See Section 12.
3. What we collect

- Information from third parties – lead providers, public sources, data enrichment tools, and business partners, consistent with applicable law
4. How we use personal information
We use personal information to:

- fulfill orders, process payments, and provide customer support
- send service notices, security alerts, and administrative messages
- send marketing emails with your consent where required and allow you to unsubscribe at any time
- personalize content and measure campaign performance
- detect, investigate, and prevent security incidents and fraud
- comply with law and enforce our Terms
For EEA and UK residents, our lawful bases include contract necessity, legitimate interests, consent, and legal obligation. You can withdraw consent at any time without affecting pre-withdrawal processing.

We do not sell personal information for money. We may share identifiers and internet activity with advertising partners for cross-context behavioral advertising or targeted advertising as those terms are defined by certain state laws. You can opt out as described in Section 8.
7. Retention
We keep personal information for as long as needed to provide the Services, to comply with our legal and tax obligations, to resolve disputes, and to enforce our agreements. Typical periods are listed in Section 2. When retention is no longer required, we delete or de-identify data.
8. Your privacy rights
Your rights depend on your location. Subject to verification and applicable law, you may have the right to:
- Access and portability – request a copy of personal information we hold about you
- Correction – request that we correct inaccurate personal information
- Deletion – request that we delete personal information, subject to legal exceptions
- Opt out of sale or sharing and targeted advertising – opt out of the disclosure of personal information to advertising partners for cross-context behavioral advertising or targeted advertising
- Restrict the use of sensitive personal information – for California residents, to the extent applicable
- Appeal – appeal our decision if we decline your request, where required by law
Submit requests by emailing [email protected]. We will verify your request by reasonable means such as confirming control of your email address or other information. You may designate an authorized agent to submit a request on your behalf as permitted by law.
Do Not Sell or Share. If we maintain a “Do Not Sell or Share My Personal Information” link on the site, you can use it to opt out. We also treat qualified Global Privacy Control signals as opt-out preferences.
Marketing choices. You can unsubscribe from marketing emails using the link in the email. You will still receive transactional and service messages.
9. Security
We use administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit, access controls, logging, and vendor due diligence. No method of transmission or storage is fully secure. You are responsible for keeping your account credentials confidential and for using appropriate security on your devices.
10. International transfers
If you are in the EEA, UK, or Switzerland, your personal information may be transferred to countries that do not provide the same level of data protection. Where required, we use appropriate safeguards such as standard contractual clauses. By using the Services you understand your information may be processed in the United States and other countries.
11. Testimonials and user content
With your permission, we may display testimonials that include your name and business. If a testimonial provider received any consideration, we disclose that where the testimonial appears. You can request removal by emailing [email protected].
12. Children’s privacy
The Services are not directed to children under 13 and we do not knowingly collect personal information from children under 13. If you believe a child has provided personal information to us, contact [email protected] and we will take appropriate action.
13. Links and third parties
The Services may contain links to third-party sites. We are not responsible for their privacy practices. Review the privacy policies of any third-party site you visit.
14. Processor terms for client projects
When we process personal information on behalf of a client, we will:
- process personal information only on documented instructions from the client
- implement appropriate security measures
- ensure personnel confidentiality
- assist the client with data subject requests and incident notifications where reasonably possible
- delete or return personal information at the end of the engagement, unless retention is required by law

15. State-specific disclosures
- California residents. You have rights under the California Consumer Privacy Act as amended by CPRA, including the rights listed in Section 8. We do not knowingly sell or share personal information of consumers under 16. We do not use or disclose sensitive personal information for purposes that require a right to limit.
- Texas residents. Under the Texas Data Privacy and Security Act, you may have rights to access, correct, delete, and opt out of targeted advertising and the sale of personal data.
- Other states. Similar rights may apply in Colorado, Connecticut, Virginia, Utah, Oregon, and other states with comprehensive privacy laws.
16. Changes to this Privacy Policy
We may update this Privacy Policy from time to time. If we make material changes, we will provide notice such as posting a notice on the site or emailing you. The “Updated” date shows the latest revision. Your continued use of the Services after an update means you accept the changes.
